1. Who We Are
Nunatak Biotech S.A.S. ("the Company," "we," "us," or "our"), located at Av. del Libertador 6250, Piso 4, C1428ARV, Buenos Aires, Argentina, is the data controller for personal information processed through nunatakbiotech.com (the "Site").
The Company is an AI-driven microbial biostimulant discovery company. Our work involves collecting soil samples from extreme environments in Patagonia, screening microbial isolate genomes with computational biology tools, and developing biostimulant candidates for growers and agricultural input companies dealing with salt stress and cold stress in crops. The personal information this policy describes is limited to what we collect in operating this research website and our partner portal.
For privacy questions, contact the Company's Data Protection Contact at: [email protected].
2. Information We Collect
We collect personal information in the following contexts:
- Contact and inquiry data: when you submit the contact form on our site (name, organization name, email address, inquiry type, and any message content you include). We use this to respond to your inquiry.
- Partner portal credentials: email address and authentication tokens used to log in to the Partner Portal by growers and agricultural input companies with active pilot or licensing access.
- Research communication data: email correspondence with field trial partners, agronomists, and research collaborators regarding pilot programs, data sharing, or licensing discussions.
- Technical and usage data: IP address, browser type, pages visited, and timestamps collected automatically when you access the Site. This data is used to operate and monitor the Site.
- Cookie data: as described in our Cookie Policy.
We do not collect soil or genomic data through this website. Soil sample collection and microbial isolate analysis are conducted by the Company under separate field research protocols and are not subject to this privacy policy.
We do not collect sensitive personal information (health data, biometric data, financial account numbers, or government identification) through this Site.
3. How We Use Information
We use the information we collect to:
- Respond to research inquiries, pilot program interest, and licensing requests submitted through the contact form.
- Operate and maintain the Partner Portal for active pilot and licensing partners.
- Communicate with field trial partners and research collaborators about candidate strain data, trial scheduling, and results.
- Monitor Site performance, diagnose technical issues, and improve the experience for visitors.
- Comply with applicable legal obligations under Argentine law.
We do not use personal information for automated decision-making that produces legal or similarly significant effects on individuals. We do not sell, rent, or exchange personal information with third parties for their marketing purposes.
4. Legal Basis for Processing
Under the Argentina Personal Data Protection Act (Law 25.326) and applicable Argentine law, we process personal information on the following bases:
- Your request: when you contact us through the Site, you are initiating that communication and we process the data you provide to respond.
- Contract performance: for Partner Portal users with active pilot or licensing agreements, processing is necessary to perform those agreements.
- Legitimate interest: we process technical and usage data to operate and secure the Site, including fraud and abuse prevention.
- Legal obligation: where Argentine law requires us to retain or disclose information.
5. Sharing and Disclosure
We share personal information only in the following limited circumstances:
- Service providers: third-party technology providers who host the Site, manage email delivery, or provide analytics services on our behalf, under written agreements that restrict their use of personal information to services for us.
- Research partners: where a field trial or licensing agreement requires sharing contact or communication data with a partner organization, we do so only to the extent covered by that agreement and with your awareness.
- Legal requirements: when disclosure is required by Argentine law, court order, or government authority.
- Business transfer: in the event of a merger, acquisition, or transfer of substantially all of our assets, personal information held by the Company may be transferred as part of that transaction. We would notify you before any such transfer and before any different privacy policy applies to your information.
We do not transfer personal information internationally except to service providers in countries that provide an adequate level of protection or under appropriate contractual safeguards consistent with Argentine requirements.
6. Retention and Security
We retain personal information for as long as it is needed for the purpose it was collected, and then for any additional period required by Argentine law. In practice:
- Contact form inquiries are retained for up to 24 months in case the conversation leads to a later partnership or licensing discussion.
- Partner Portal account data is retained for the duration of the active agreement and for a reasonable period after termination for record-keeping.
- Technical and usage log data is retained for up to 12 months and then deleted or anonymized.
We apply technical and organizational security measures appropriate to an early-stage research company: access controls on systems holding personal data, encrypted data-in-transit, and internal handling procedures. No system is completely secure, and we cannot guarantee absolute security.
7. Your Rights Under Argentine Law
Under the Argentina Personal Data Protection Act (Law 25.326), you have the right to:
- Access: request information about whether we hold personal data about you and, if so, what data we hold.
- Rectification: request correction of inaccurate or incomplete data.
- Deletion (suppression): request deletion of data that is no longer necessary for the purpose for which it was collected, or that was collected unlawfully, subject to any legal retention obligation.
- Confidentiality: request that processing be restricted where you contest accuracy or object to our use.
To exercise any of these rights, contact us in writing at [email protected], identifying yourself and describing your request. We will respond within 30 calendar days. Under Law 25.326, you also have the right to file a complaint with the Agencia de Acceso a la Informacion Publica (AAIP), the Argentine data protection authority.
8. Cookies
We use a small number of cookies on this Site for operational purposes and basic analytics. Our Cookie Policy describes the categories we use, their lifetimes, and how to control them. The Site uses a notice-only consent model consistent with Argentine practice as of the date of this policy.
